Borderline — Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Borderline mobile application ("App") operated by Peter Yeung ("Developer", "we", "us", or "our").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Description of Service
Borderline is a travel tracking and informational tool that uses GPS-based location detection to log international border crossings and estimate days of physical presence or absence from countries. The App also provides residency and immigration-related calculations, trip simulations, and absence reports.
2. Not Legal, Immigration, Tax, or Professional Advice
IMPORTANT: The App is an informational tracking tool only. It does not provide legal, immigration, tax, or professional advice of any kind.
- No attorney-client, solicitor-client, accountant-client, or other professional relationship is created by your use of the App.
- Immigration and residency laws are complex, vary by jurisdiction, and change frequently without notice. Calculations, estimates, thresholds, timelines, and other information provided by the App may not reflect current legal requirements or your actual legal obligations.
- The App's calculations are based on GPS detection timestamps and user-entered data, which may differ from official records (passport stamps, I-94 records, airline records, or government databases).
- You should always consult a qualified immigration attorney, solicitor, or relevant professional before making any decisions related to your immigration status, residency, citizenship applications, or tax obligations.
- Do not rely solely on this App for any immigration-related decision.
3. Disclaimer of Warranties
THE APP AND ALL CONTENT, CALCULATIONS, DATA, REPORTS, AND INFORMATION PROVIDED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT.
We do not warrant that:
- (a) Calculations, day counts, threshold alerts, or eligibility estimates will be accurate, complete, or current;
- (b) The App will meet your specific requirements or circumstances;
- (c) The App will be uninterrupted, timely, secure, or error-free;
- (d) GPS-based border detection will capture every border crossing or capture them at the correct time;
- (e) Any information obtained through the App will be accurate or reliable;
- (f) Immigration rules, thresholds, or qualifying periods coded into the App will reflect the most current law or policy; or
- (g) Any defects or errors in the App will be corrected.
4. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER, ITS AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR:
- Loss of immigration status or residency rights
- Denial or delay of visa, permanent residency, or citizenship applications
- Non-refundable government application fees lost due to denied applications
- Deportation, removal proceedings, or re-entry bars
- Tax liabilities or penalties
- Loss of profits, data, use, goodwill, or other intangible losses
RESULTING FROM:
- (a) Your use of or inability to use the App;
- (b) Any errors, inaccuracies, or omissions in calculations, day counts, threshold alerts, reports, or other content;
- (c) Any decisions you make based on information provided by the App;
- (d) Failure of GPS-based detection to accurately capture border crossings;
- (e) Changes in immigration law, regulation, or government policy that are not yet reflected in the App; or
- (f) Any unauthorized access to or alteration of your data.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR TWENTY US DOLLARS ($20.00), WHICHEVER IS GREATER.
5. User Responsibility
You acknowledge and agree that:
- You are solely responsible for verifying all calculations, day counts, and information provided by the App against official government records and sources before taking any action.
- You are solely responsible for all decisions you make based on information displayed in the App, including but not limited to decisions about travel, immigration applications, and residency.
- Manual entries you add to the App are not verified by GPS and may contain errors.
- The App's absence reports are generated for your personal reference and convenience only. They are not certified, notarized, or endorsed by any government authority.
- Background location tracking may stop or become inaccurate due to device settings, operating system behavior, battery optimization, or other factors outside our control.
6. Indemnification
You agree to indemnify, defend, and hold harmless the Developer from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- (a) Your use of the App;
- (b) Any decisions you make based on information or calculations provided by the App;
- (c) Your violation of these Terms; or
- (d) Your violation of any applicable law or regulation.
7. Changes to Immigration Rules
Immigration laws, regulations, policies, and government procedures change frequently and without notice. There may be a delay between when a legal change takes effect and when the App is updated to reflect that change. We are not obligated to update the App on any particular schedule.
You are responsible for independently verifying that the rules and thresholds used by the App are current and applicable to your specific situation.
8. Subscription and Payment
- Borderline Premium is available as an annual subscription. Payment is charged to your Apple ID account at confirmation of purchase.
- The subscription automatically renews unless cancelled at least 24 hours before the end of the current period.
- You can manage or cancel your subscription in your Apple ID account settings.
- Refunds are handled by Apple in accordance with their refund policies.
9. Privacy
Your privacy is important to us. Please review our Privacy Policy for information about how we collect, use, and protect your data. Key points:
- All travel data is stored on your device and synced via your private iCloud account.
- We do not operate servers that store your data.
- We do not use third-party analytics or advertising services.
- No user account or personal information is required to use the App.
10. Dispute Resolution and Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
You and the Developer agree to waive any right to participate in a class action lawsuit or class-wide arbitration against the Developer.
The arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA) or JAMS, at the claimant's election. The arbitration shall take place in the jurisdiction where the Developer resides or, at your election, online.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Developer resides, without regard to its conflict of law principles.
12. Severability
If any provision of these Terms is held to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
